Cardrealm Terms and Conditions for Online Shop


Access to and placing orders on the Cardrealm Online Shop (Online Shop) is provided to You (the Customer) by James
Cash trading as Cardrealm (Us / We) subject to these terms and conditions (Online Shop Terms and Conditions).
By using the Cardrealm Website: www.cardrealm.com.au (Our Website) to make a purchase, You agree to be bound
by these Online Shop Terms and Conditions. The Online Shop Terms and Conditions also incorporate our Cardrealm
Website Legals and Cardrealm Privacy Policy, both linked on our website.
We reserve the right to amend these Online Shop Terms and Conditions from time to time. Your continued of the
Online Shop will constitute acceptance that You are bound by the Online Shop Terms and Conditions as amended.


1. Product
(a) Cardrealm was created for TCG enthusiasts and offers a range of affordable and authentic cards for sale via our
online shopping platform (Product(s)).
(b) Products listed on the Online Shop are listed for sale by either the owner of Our Website as a Vendor (Vendor), or
by vendors approved in accordance with these terms and conditions to list Product(s) for sale in the Online Shop
(Approved Vendors).


2. Accuracy / Corrections
(a) Whilst care has been taken to ensure that the Product(s) and descriptions attributed to them in the Online Shop
are accurate and up to date, We do not promise or represent that content on the Online Shop is accurate or free
from errors or omissions.
(b) We reserve the right to make any necessary corrections to the Online Shop.


3. Prices
(a) The Price(s) for our Products are listed on Our Website in our Online Shop.
(b) The Vendor and each Approved Vendor will be independently responsible for setting the price of the Product(s)
offered for sale by them in the Online Shop, including any delivery or other applicable charges.
(c) All prices are:
(i) Exclusive of postage and delivery charges, which will be calculated and added at the checkout;
(ii) Inclusive of Australian Goods and Services Tax where that is applicable; and
(iii) Shown are in Australian dollars.


4. Purchasing Product from the Online Shop
(a) You may place an order for Product(s) by following the prompts in the Online Shop.
(b) Selected items will be listed in the Cart Summary.
(c) In respect of each Product(s) listed in the Cart Summary, Your order is an offer from You to the relevant Vendor
or Approved Vendor to buy that Product(s) from that Vendor or Approved Vendor.
(d) Where You purchase Product(s) from more than one Vendor or Approved Vendor, You offer to enter a separate
contract with each Vendor or Approved Vendor on these terms and conditions in respect of the Product(s) supplied
by that Vendor or Approved Vendor.
(e) You must pay for all online purchases at the time of reaching the Checkout in accordance with one of the payment
methods offered on Our Website.
(f) Your order will be complete once payment is credited to the bank account of the Vendor and/or the Approved
Vendor (Order).
(g) Each Vendor or Approved Vendor is independently responsible for dispatching Product(s) to you in compliance
with these terms and conditions.
(h) The Vendor or Approved Vendor will be bound to supply You the Product(s) the subject of the Order, once
payment has been processed and Our Website has sent you an email order confirmation (Order Confirmation).
(i) Where the Vendor or Approved Vendor cannot fulfil an Order, a refund will be provided.


5. Delivery of Product
(a) The Vendor or the Approved Vendor will endeavour to dispatch an order within 2 business days of the Order
Confirmation email being sent to You.
(b) All Orders placed on Our Website are shipped using the services of Australia Post. Carriage of articles and delivery
times will be in accordance with the Australia Post terms and conditions as they apply from time to time.
(c) Title to the Product(s) passes to You following issue of the Order Confirmation Email and the Product(s) the subject
of the Order will be shipped at the risk of the Purchaser.
(d) The Customer will receive an email from Us or the Vendor once the Product(s) have been delivered to Australia
Post for shipping (Shipping Confirmation Email). Where the Customer:
(i) Has selected tracked shipping, then the tracking number will be sent with the Shipping Confirmation Email;
and
(ii) Has selected untracked shipping, the envelope will be marked with a date stamp and the shipping details
photographed and sent after the Shipping Confirmation Email as proof of shipping. The shipping detail
photograph will be retained for 6 weeks only.


6. Returns policy (including change of mind returns)
(a) If You have changed your mind in relation to any Product(s) purchased from our Online Shop, We are not
required to accept a return or provide a refund of the purchase price, unless the Product(s) fails to meet a
consumer guarantee applicable under the Australian Consumer Law.
(b) All Product(s) come with guarantees that cannot be excluded under the Australian Consumer Law. You are
entitled to a replacement for or refund for a major failure and compensation for any other reasonably
foreseeable loss or damage. You are also entitled to have the Product(s) repaired or replaced if the Product(s)
fail to be of acceptable quality and the failure does not amount to a major failure.
(c) We will require satisfactory proof of purchase before providing a remedy under the Australian Consumer Law.
We may require You to return the Product(s) to Us to be assessed within a reasonable period of time of your
receipt of the Product(s). Where a Product(s) is damaged through misuse, neglect or abnormal use, We will
not provide a refund, exchange or repair.
(d) All other warranties and representations are excluded, except those which are non-excludable in law,
including the Australian Consumer Law.
(e) To assist the Vendor or Approved Vendor in resolving any issues You may experience, please inspect the
Product(s) upon taking delivery and report any shortage, discrepancy, defect, wrong specification or similar
problem to the Vendor or Approved Vendor as soon as you become aware of it.


7. Privacy
(a) When you interact with the Online Shop, we may ask for your personal information. Without this information, will
we be unable to provide You with our services. Your information is handled in accordance with the Card Realm
Privacy Policy, which outlines how you can access your personal information, or make a privacy related complaint.

8. Approved Vendors and Application Process
(a) We may, within Our sole discretion, agree to other card holders becoming a vendor in the Online Shop
(Approved Vendor).
(b) You may apply to become an Approved Vendor by accessing the Login/Register page on Our Website and
completing the details requested on those pages (Application to Become an Approved Vendor).
(c) Upon receipt of the Application to Become an Approved Vendor, We will advise whether the Application is
approved or declined.
(d) When You apply to Become an Approved Vendor, You will be supplied with an electronic copy of the “CRM
Setup and Shipping Know-How” from Us. You agree to read the “CRM Setup and Shipping Know-How” before
accessing the Vendor Dashboard and/or uploading any products.
(e) If You become an Approved Vendor then You agree to be bound by these terms and conditions in relation to
sale of Product(s), including to pay to a commission to Us.


9. Approved as Vendor
(a) If You are approved as an Approved Vendor, You may list Your cards for sale on Our Website by following the
steps listed in the “CRM Setup and Shipping Know-How”.
(b) To create Your own Product(s), You will need to supply photographs of the cards You wish to sell, input product
and similar detail to identify the cards and establish their authenticity.
(c) Notwithstanding You hold Approved Vendor status, We retain the right to delete Your Product(s) if the
information uploaded by You is inappropriate, misleading or otherwise inconsistent with Our requirements
and those of Our Website.
(d) Where a Customer places an Order for Your Product:
(i) The Customer will be prompted to provide payment details so that payment may be made via Stripe
or PayPal;
(ii) As an Approved Vendor You agree You will pay to Us a commission calculated as set out on the
Application to Become an Approved Vendor (Cardrealm Commission); and
(iii) The Cardrealm Commission will be directed to the Cardrealm Bank Account, and the balance Purchase
Price after deduction of the Cardrealm Commission will be directed to the Vendor Bank Account.
(e) As an Approved Vendor You will:
(i) Have access to the Vendor Dashboard in the Online Shop;
(ii) Receive email confirmation once an Order is completed, and You will also be able to track Orders via the
‘Orders’ Tab on the Vendor Dashboard;
(iii) Be responsible for assembling, packaging, and shipping any Product(s) acquired through the Cardrealm
Website to the Customer, in accordance with the shipping guidelines made available to Approved Vendors
(Shipping Guidelines), once the transaction is complete;
(iv) The Shipping Guidelines include the requirement to use card sleeves to protect the Product(s) against
scratches and getting wet, and a toploader plastic sheet to prevent the Product(s) being bent during
shipping;
(v) Send the Shipping Confirmation Email (referred to in clause 5 above) via the Vendor Dashboard once the
Order has been shipped to the Customer;
(vi) Be primarily responsible for responding to customer complaints as follows:
A. The customer will be requested to contact the Vendor or Approved Vendor directly to notify any
complaint or issue (Complaint);
B. If the customer does not receive a reply from the Approved Vendor within 72 hours of notifying
of the Complaint, the customer may contact Cardrealm directly who will in turn contact the
Approved Vendor to address the Complaint;
The failure of you as the Approved Vendor to respond to Cardrealm within 72 hours of the direct contact,
will entitled Cardrealm to either suspend or terminate your Approved Vendor status in its absolute
discretion.


10. General
(a) These Terms are governed by and are to be construed in accordance with the laws of Queensland, Australia.
(b) If any provision of these Online Shop Terms and Conditions is found to be invalid or unenforceable by a court
of law, such invalidity or unenforceability will not affect the remainder of the Online Shop Terms and
Conditions which will continue in full force and effect.
(c) You may not assign any rights or benefits under this agreement without Your prior written consent.
(d) This agreement is the entire agreement and understanding between the parties on everything connected with
the subject matter of this agreement, and supersedes any prior understanding, arrangement, representation,
or agreements between the parties as to the subject matter contained in this agreement.
(e) An amendment or variation to this agreement is not effective unless it is in writing and signed by all the parties.
(f) Any waiver by any party to a breach of this agreement shall not be deemed to be a waiver of a subsequent
breach of the same or of a different kind.
(g) Neither party shall be liable to the other party for any loss caused by any failure to observe the terms and
conditions of this agreement, where such failure is occasioned by causes beyond its reasonable control
including but not limited to by fire, flood, riot, strike, war, restrictions and prohibitions or any other actions by
any government or semi government authorities.
